Overtime Payments and Pay During Annual Leave
Following a legal case (Flowers), NHS Employers have agreed a settlement for overtime payments and pay during annual leave. Employers should now include regularly worked overtime and additional standard hours in the calculation of pay when staff are on annual leave.
This currently only applies to colleagues in England. Similar exercises are taking place in the devolved administrations. NHSBT Pay Support will contact colleagues directly if they are affected by this.
Payments and Eligibility
Corrective payments will be made to those eligible for the periods covering the financial years 2019/2020 and 2020/2021.
Those eligible are:
- colleagues employed in NHS on 31 March 2021, and
- have received payments for overtime in a minimum of four months out of the 12 months in the financial year 1 April 2019 to 31 March 2020 and/or 1 April 2020 to 31 March 2021
Pay Support are working to check the calculations generated by the NHS national pay system ESR.
Affected colleagues will receive a letter before September pay day, with the correction amount they will be paid. Payments will be made in September 2021.
